The ISABIAL FOUNDATION, as the entity responsible for this website (hereinafter, the CONTROLLER), makes this document available to users in order to comply with the obligations set out in Law 34/2002 of 11 July on Information Society Services and Electronic Commerce (LSSICE), published in the Spanish Official State Gazette No. 166, as well as to inform all users of the website about the terms and conditions of use.

Any person who accesses this website assumes the role of user and undertakes to observe and strictly comply with the provisions set forth herein, as well as with any other applicable legal provision.

The ISABIAL FOUNDATION reserves the right to modify any type of information that may appear on the website, without any obligation to provide prior notice or inform users of such changes, it being understood that publication on the ISABIAL FOUNDATION website shall be sufficient.

The website — including, by way of example but not limited to, its programming, editing, compilation and other elements necessary for its operation, as well as the designs, logos, text and/or graphics — is the property of the CONTROLLER or, where applicable, is used under licence or with the express authorization of the respective authors. All the contents of the website are duly protected by intellectual and industrial property regulations and are registered in the corresponding public registries.

Regardless of the purpose for which they are intended, the total or partial reproduction, use, exploitation, distribution or commercialisation of the contents requires, in all cases, prior written authorization from the CONTROLLER. Any use not previously authorised shall be considered a serious breach of the author’s intellectual or industrial property rights.

Designs, logos, text and/or graphics not belonging to the CONTROLLER and which may appear on the website are the property of their respective owners, who are themselves responsible for any possible dispute that may arise regarding them. The CONTROLLER expressly authorizes third parties to link directly to specific content on the website and, in any case, to redirect to the main website at www.isabial.es.

The CONTROLLER acknowledges the corresponding intellectual and industrial property rights in favour of their legitimate owners. The mere mention or appearance of such elements on the website does not imply the existence of any rights or responsibility over them, nor any endorsement, sponsorship or recommendation by the CONTROLLER. ISABIAL accepts no liability for any information published on its website when such information has been manipulated or inserted by an external third party.

The information on the ISABIAL website is for guidance only and is not binding. ISABIAL does not guarantee that the content is up to date, accurate or complete, and accepts no liability for any potential harm caused to users or third parties. For health‑related matters, professional medical advice is always recommended. ISABIAL is not responsible for content provided by collaborators, clients or users.

3.2. Security Measures and Operation:

Although ISABIAL has taken measures to ensure the proper functioning of the website, it accepts no liability for direct or indirect damages arising from access to, use of, or the operation of the website, including interruptions, technical failures or any other cause. This also includes issues related to networks and computer systems.

ISABIAL accepts no liability for damages caused by unauthorised access, improper knowledge by third parties regarding the use of the website, or the transmission and storage of content. 5. LINK POLICY

From the website, it is possible to be redirected to content on third‑party websites. Since ISABIAL cannot always control the content introduced by third parties on their respective websites, it assumes no responsibility for such content. In any case, ISABIAL will proceed to the immediate removal of any content that may contravene national or international legislation, morality or public order, removing without delay the redirection to the corresponding website and informing the competent authorities of the content in question.

ISABIAL is not responsible for the information and content stored, including but not limited to forums, chats, blog generators, comments, social networks or any other medium that allows third parties to publish content independently on the ISABIAL website. However, in compliance with Articles 11 and 16 of the LSSICE, ISABIAL makes itself available to all users, authorities and law enforcement agencies, actively collaborating in the removal or, where appropriate, blocking of any content that may affect or contravene national or international legislation, third‑party rights, or morality and public order. Should the user consider that there is any content on the website that may fall under this classification, they are requested to notify the website administrator immediately.

This website has been reviewed and tested to ensure its proper functioning. In principle, correct operation can be guaranteed 24 hours a day, 365 days a year. However, ISABIAL does not rule out the possibility of programming errors or the occurrence of force majeure events, natural disasters, strikes or similar circumstances that may make access to the website impossible.

6. DIRECCIONES IP

The website’s servers may automatically detect the IP address and the domain name used by the user. An IP address is a number automatically assigned to a computer when it connects to the Internet. All this information is recorded in a duly registered server activity log that allows the subsequent processing of the data for the sole purpose of obtaining statistical measurements, such as the number of page impressions, the number of visits made to the web servers, the order of visits, the point of access, and similar metrics.

7. DONATION PROCEDURE AND ACCEPTED PAYMENTS

Users may make donations on the ISABIAL website by following the procedure and payment methods specified in the “Donations” section.

Once ISABIAL receives the donations, they are considered irrevocable, except as provided under civil law regarding the revocation of donations.

To make a donation, the donor shall select the amount, indicate the intended recipient of the donation, provide their personal details and the chosen payment method (credit card or Bizum), and click “proceed to payment”. The donor must provide truthful, accurate and complete information regarding their identity.

If the donation is made by credit card, the donor will be redirected to the secure REDSYS website, where they must enter their card details: number, expiry date and security code. The virtual POS page includes security protocols to ensure the confidentiality of the information. Visa, Mastercard and Maestro cards are accepted.

ISABIAL will have access to the donor’s card details and the payment‑processing entity in order to manage payments and collections. Credit cards are subject to verification and authorization by the issuing entity.

If the donation is made via Bizum, the donor will be redirected to the secure REDSYS website and will enter their telephone number. To use the Bizum service, the donor must have their mobile phone number linked to their bank account.

In compliance with EMVCo regulations, MasterCard, VISA and the European PSD2 Directive, during the electronic payment process information relating to the connection used in the session will be communicated to the card‑issuing bank in order to validate the payment transaction carried out by the user.

If the banking entities do not authorize the payment, ISABIAL shall not be held responsible for the failure to formalize the donation. The user must inform ISABIAL as soon as possible of any improper charge, error or fraud involving the card used for the donation, by contacting info@isabial.es or calling 965 913 948.

8. APPLICABLE LAW AND JURISDICTION

For the resolution of any disputes or matters related to this website or the activities carried out on it, Spanish legislation shall apply, to which the parties expressly submit. The Courts and Tribunals of ALICANTE shall have jurisdiction for the resolution of all conflicts arising from or related to its use.

9. AMENDMENTS AND ENTRY INTO FORCE OF THE LEGAL NOTICE

These terms and conditions enter into force as of their date of publication. ISABIAL reserves the right to modify, update, remove or cancel, at any time and without prior notice, the information, activities, content and services offered on its website. It may also change the configuration and presentation of the site and the conditions of access, whether temporarily or permanently. Users must ensure that they are always using the most up‑to‑date version. This right does not grant users any entitlement to compensation for damages.
